Yes, it truly is private property. It is also a public establishment (but not public property). Which means that the owner of the private property allows people to be on the property when they are a customer of the business.

Being a customer allows you to be on the property for the express purpose of being a customer. It does not entitle you to solicit on their property.

No, you're completely wrong about 'private property'. It is private property that the public is allowed to enter freely. At any point in time, the property owner can ban (sign a tresspass warrant) against anyone for any reason they see fit.

Look at it this way: would you continue going back to Best Buy's parking lot and soliticit customers even if the manager continues to ask you to leave?

No, we're pointing out the errors of your ways and trying to guide you in proper business practices.

And yes, they are concerned because you're basically violating their right to operate their business on their property.

If you think we waited a week for you to return just so we could publicly ridicule you, you have an inflated picture of yourself.

As I said in the previous post, you are taking our comments too personally. We aren't attacking you personally, we're suggesting your method of attracting customers is suspect.

Step back and see what you would say to someone else on the forum who is doing the same thing as you.

I really am failing to see how me putting up flyers is illegal. I mean, I see people all the time putting up flyers in front of Wal-Mart and other business...How is that any different? Where EXACTLY am I breaking the law?? Soliciting?? But theres no "No soliciting" signs anywhere around in the parking lot or on their stores windows. So how is what I'm doing considered illegal??

C'mon, you know better than this. A law doesn't have to be posted everywhere for it to be a law. A store and its parking lot are private property, so they can control what happens on their property.

Some businesses such as Wal-Mart allow people to solicit (Girl Scouts), but they do so with express permission, and often time restrictions (hours per day or days per week).

Also, just because other people are doing it, does not make it legal.

As I said, you're not likely to be arrested and cuffed for doing what you're doing, but you will probably get a bad reputation among retailers that will be hard to rid. And this reputation could adversely affect your business down the road.

This is not aggression. What you're misreading as aggression is not a personal attack against you or your business, rather than a legitimate critique that your method of getting customers is not a good way of doing business.

I am personally happy that you have so much business, and that your business is doing well. Hands on experience is some of the best training you can get. I want you to succeed and I want your business to succeed. But I want it to succeed in a good, positive way.
