Are these online "wargames" sites legal to attack? (By legal I don't mean ISP terms of service, I mean legal in a court of law.) Normally a pentester would get permission in writing detailing the scope of the test but these sites don't offer that.
How are they being setup so that they don't leave the legitimate servers open to attack? Once inside anyone can then attempt further attacks on switches/routers and other servers on the network, etc...
Would you guys recommend using these resources?

Look at the section (by thorin) Testing Environments & Apps: especially the hacking without all the jail-time part.
That post mentioned is also missing MaXe's site http://www.Intern0t.net as soon as they recover from a recent attack it should have some wargames stuff on it.
