    Short answer: Yes.

Long answer: It hasn't been prosecuted to my knowledge with a WEP or WPA key, but there are plenty of parallels in prior case law where convictions have resulted. The defense of "I illegally obtained and possessed the [data/credit card numbers/account numbers] because I was curious, but never intended to use them for illicit purposes" just doesn't work.

They have a saying for that in court: "GUILTY!"
