you also might make sure wicd is set to wlan0 and eth0 in pref's as default i think is wlan1 and eth1
if you were just trying to get wicd to scan

i found a nasty fix for the problem that i do not like
i reinstalled linux-image-2.6.39.4

now i have no error although i dont believe i have r3 update and also i now have 2 kernels installed...
